Passenger rights

In the event of a flight delay, cancellation or overbooking, you usually have far-reaching claims against your airline. For example, if your flight is delayed by three hours or more, you are entitled to a flat-rate compensation payment of EUR 250.00 / 400.00 / 600.00 (depending on the flight route) under the Air Passenger Rights Ordinance.

If your luggage is lost or damaged, you also have claims against the airline, which usually has to compensate for the damage. Even if you cancel a flight ticket that cannot be canceled according to its conditions and does not allow a refund, at least a partial refund can often be obtained, taking into account current case law. We inform you about your rights and how you can enforce them. The Duran law firm will be happy to support you in Hanover and nationwide with your legal problems relating to your flight.

Missed connecting flight?

If you did not catch your connecting flight, you as a passenger are entitled to claims for damages under EC Regulation 261/04. Compensation for a route outside the EU of around 3,500 km is entitled to €600 per person. The airline does not have to pay compensation for a flight delay or flight cancellation if extraordinary circumstances are responsible. These include strikes, storms or the threat of terrorism. Airlines often use alleged exceptional circumstances to avoid paying compensation. It is difficult for passengers to check which reasons are responsible for the flight delay or flight cancellation.

Package travel law

In the case of package tours, you are entitled to a reduction in the travel price from your tour operator if defects occur during the trip. Report the defects to your tour operator immediately and ask them to remedy the situation.

The so-called Frankfurt table helps you to get an initial overview of how high your claims against the tour operator are due to defects that have occurred. However, the values only serve as a guide. We would be happy to examine your individual case. and are available to answer any questions you may have.

Cancellation of the travel contract

The traveler can withdraw from the booked trip at any time before the start of the trip informally and without giving reasons. However, they then have to pay reasonable compensation in the form of cancellation costs to the organizer. The cancellation costs for a typical package tour with flight and hotel are calculated specifically:

In addition to the possibility of termination, the traveler has an additional special right of termination in the event of force majeure. Force majeure is a sudden external event that is neither attributable to the organizer nor to the traveler and cannot be averted by taking the utmost care.
